❖ Auction

If the adopt is labeled ‘Auction’, please reply to the comment linked in the artist’s description, under the words ‘Bid Here’ for your offer. Please reply in a chain, to enable previous bidders to keep track of the bids. SB or Starting Bid is the minimum price of the adopt, and will be mentioned in the description. AB or Autobuy is the set price that will immediately grant the bidder the adopt without having to wait for other bids. In this case, reply with ‘AB’ or ‘Autobuy’ in the link provided.

❖ Set Price

If the adopt is labeled ‘Set Price’, it may be bought without an auction by commenting on the adoptable or messaging me privately (Discord/Toyhouse).

❖ Offer to Adopt

If the adopt is labeled ‘OTA’ or ‘Offer to Adopt’, please read further instructions in the artist’s description of the said adopt.

❖ All payments must be done in USD (via PayPal)

❖ If the buyer is Polish/from Poland, the payment can be done in PLN, otherwise only USD is accepted. USD is always preferred.

❖ Payment has to be done upfront.

❖ Refunds are not accepted.

❖ The buyer is buying limited rights to the artwork of the adoptable and adoptable itself. Which rights are being bought exactly will be explained further into this ToS document.

❖ The physical copy of the adoptable/artwork of the adoptable will NOT be shipped to the buyer. The adoptable/artwork of the adoptable is available only in the digital version.

❖ Chargebacks are not allowed.

❖ Reasoning chargebacks by the buyer saying their order has not been processed while it was and there are witnesses (people who follow me on social media etc.), as well as the proof is in the correspondence, is not allowed. In case of such, PayPal's staff will be contacted.

❖ The adoptable/artwork of the adoptable is non-physical and the buyer understands that.

❖ By paying the invoice the buyer confirms they are the owner of the PayPal account they are paying with OR they were authorized to make the payment by the owner. If, by any chance, I receive a charge back because the purchase was not made by the owner or authorized by the owner, I take NO responsibility over it.

❖ The payment is done through an invoice that is sent to the buyer by me, the artist.

❖ The buyer must send the payment in USD, even if PayPal suggests otherwise. PLN currency is reserved only for Poles/people from Poland.

❖ I do not take the responsibility if the buyer sends the money to the wrong person. Unless it was caused by my mistake.

❖ The invoice allows for adding a tip if the buyer wishes to do so. It is not obligatory, though.

❖ All terms and conditions from the "PAYMENT" section apply here as well.

❖ Auction

The bidder may only bid what they can afford.

Bid retracting is not allowed.

Editing the bid comment to make the bid lower than original offer is not allowed.

Any additional rules mentioned in the artist’s description of the adoptable are applicable.

❖ Set price

They buyer may not claim the adoptable if they cannot afford it.

Holds are allowed. The rules of holding a design are explained further into this ToS document.

❖ Offer to Adopt

Offers not able to be fulfilled by the offering person are not allowed.

‘Art slavery’ is not allowed. I do not support offering tons of artworks for an adoptable. Quality over quantity, please.

Retracting offers/hiding comments with them is not allowed.

Any additional rules mentioned in the artist’s description of the adoptable are applicable.

❖ Applies only when Autobuying an adoptable or buying a ‘Set Price’ labeled one.

❖ I can hold an adoption for one week maximum. If the buyer wishes to exceed the limit, they need to contact me, so we could discuss it.

❖ If the buyer constantly asks for holding any of my adoptables and then always fails to pay, they will not be allowed to ask for this option anymore.

❖ As the artist I hold every right to the original artwork of the design, so I may in example;

Post/display the picture anywhere I want (giving the buyer proper credit as the owner of the character(s)).

Promote myself with it in any place.

Offer the digital files on Patreon, Gumroad and similar sites.

However, I will not sell the artwork of the adoptable as prints/on t-shirts/etc. without the commissioner's proper consent. Nor will I ever sell one adoptable to more than one person.

❖ The buyer:

MAY NOT claim the original design as something they created.

MAY NOT resell the adopt they got from a Free Raffle. Only can trade or gift it.

MAY NOT use the artwork of the design for commercial purposes.

MAY NOT share my artwork of the design on their social media without the link to my DeviantART profile (felcia.deviantart.com/)

MAY NOT remove my signature from my artwork of the design.

MAY NOT claim my artwork of the design as something they created.

MAY NOT edit my artwork of the design without my consent.

MAY NOT create "templates" or "bases" from my artwork of the design.

❖ If something is not listed here, it does not mean it is allowed. If the buyer wishes to do something with the design/artwork of the design that is not listed here, they need to contact me first.

❖ The buyer:

MAY claim the bought character as their own.

MAY use the bought design (NOT my artwork of it) for commercial purposes

MAY resell the adoptable they got in a trade or an 'offer to adopt' only for its original monetary worth. This means that vouchers are NOT necessary. However, you still CAN’T resell it for more than its original worth.

MAY use the adopt in a roleplay group, with the condition of crediting me, as the artist, for the design and for the original artwork.

MAY resell the adoptable for the same price they bought it, no more. If the design has additional commissioned artwork the buyer can add the amount they spent on it to the price of the adoptable. If the design has additional artwork made by the buyer, they are allowed to add the artwork(s)’s monetary worth to the character’s monetary worth. Otherwise, under no circumstances the buyer is allowed to resell the design for the higher price without my proper consent.

MAY freely trade/gift the design.

MAY make minor edits to the adopt. Please do not change everything to a point of it being unrecognizable.

MAY share the artwork of the design on their social media with the link to my DeviantArt profile (felcia.deviantart.com)

Can ask for my help in featuring their journal/poll/deviation where they resell/trade one of my designs

❖ If I did not list something, please, contact me.

❖ It always makes me really happy when I see my adoptables in use! That means, if you want to, you can always mention me/note me whenever you commission/request a drawing of the design you bought from me or do the drawing yourself! Of course, you do not have to do it, if you do not feel like it. It is totally up to you!

❖ If I change my mind about selling a certain adoptable and no one has paid for it yet/it is not closed yet, I have the right to close the adoptable and claim the character as my own, whenever I wish to.

❖ After receiving the full payment or the first installment the commissioner will be sent the sketch of the commissioned artwork via a note on DeviantArt, message on ToyHouse, e-mail, etc. This is the time when the commissioner can point out any mistakes in the artwork (regarding e.g. anatomy/design/etc.) and I will fix them free of charge.

❖ I am willing to redo the whole sketch completely for free if the commissioner will change their mind about the idea for the artwork. However, more than one redo like this will be charged extra.

❖ If redoing the sketch is caused by my misunderstanding of the description for the commission, it is done free of charge, no matter the number of the needed redoes.

❖ After accepting the sketch by the commissioner, no major changes can be made.

❖ After finishing the commissioned artwork, only small changes are accepted. Bigger changes will be charged extra, such as an outfit change, outfit addition or subtraction, background change, etc.

❖ After finishing the commissioned artwork, bigger changes will be accepted only if there was a mistake done on my side (such as wrong outfit, wrong pose, wrong background, etc.)

❖ I will respect the commissioner's request to not publicly post their commission. No explanation necessary.

❖ Due to health issues/private life matters I reserve the right to take as much time to finish the commission as I need. It can vary from a few weeks to a few months. If the commissioner does not feel comfortable with it, I suggest not ordering.

❖ I tend to work when I feel most motivated so that the commission is done properly and with best effort.

❖ I do not accept setting a deadline by the commissioner.

❖ The commissioner has the right to ask about the progress of the commission whenever they wish to.

❖ As the artist I hold every right to the produced artwork, so I may in example;

Post/display the picture anywhere I want (giving the commissioner proper credit as the owner of the characters(s)).

Promote myself with it in any place.
